Terms of Service
Please read these Terms of Service carefully before using BidVictor. They describe your rights and obligations when using the platform. If you have questions, reach us at info@bidvictor.com.
1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and BidVictor (bidvictor.com), operating as a business through its website and platform ("BidVictor," "we," "us," or "our"). By creating an account, subscribing to a plan, or using any part of our platform, you agree to these Terms.
If you are acting on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree to these Terms, do not create an account or use the Service.
2. Description of Services
BidVictor is a web-based proposal assembly platform. We help contractors and service businesses prepare written proposal documents for government and public-sector solicitations. The platform:
- Accepts uploaded solicitation documents (RFPs, RFQs, IFBs, and similar)
- Extracts requirements from those documents
- Generates draft proposal narratives based on your company profile and the extracted requirements
- Produces downloadable PDF proposal documents
BidVictor does not submit bids on your behalf, does not guarantee contract awards, and does not provide legal, financial, or contracting advice.
3. Account Registration and Security
To use BidVictor, you must register an account and provide accurate, current information about yourself and your business. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us promptly at info@bidvictor.com if you believe your account has been accessed without your authorization
You must be at least 18 years old and have the legal capacity to enter into contracts. You may not register on behalf of another person without their explicit authorization.
4. Subscriptions, Fees, and Payment
Subscription plans
BidVictor offers paid monthly subscription plans. Fees are charged in advance at the start of each billing period. Current pricing is displayed at bidvictor.com/subscribe.
Payment processing
Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
No refunds on consumed slots
Each plan includes a fixed number of RFP upload slots and proposal generation slots per billing period. Slots consumed in a billing period are not refunded if you cancel or downgrade mid-period.
Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you retain access until that date.
Price changes
We may change subscription prices with at least 30 days' notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing.
5. Proposal Slots and Overage Purchases
Monthly limits
Each plan includes a set number of RFP uploads and proposal generations per calendar month. These limits reset at the start of each billing period.
Overage slots
If you exhaust your proposal generation slots before the period ends, you may purchase additional one-time slots at the then-current overage rate. Overage slot purchases are non-refundable.
Trial and evaluation access
During limited evaluation periods, certain invited users may access the platform at no charge for a fixed trial window. Trial access may be revoked at any time and does not guarantee continued free access.
6. Use of the Service; Restrictions
You agree to use BidVictor only for its intended purpose: preparing and generating proposal documents for solicitations you intend to bid on.
You may not:
- Generate proposals for solicitations you have no legitimate interest in bidding on
- Reverse engineer, decompile, or attempt to extract source code from the platform
- Use automated scripts, bots, or scraping tools against the platform
- Share your account credentials with third parties
- Use the platform to violate any applicable law or regulation
- Attempt to circumvent slot limits, billing, or other access controls
- Misrepresent your company's certifications, capabilities, or past performance in any submitted proposal
We may suspend or terminate accounts that violate these restrictions without prior notice.
7. Your Content and Data
Ownership
You retain ownership of the solicitation documents, company information, and other content you upload to BidVictor ("Your Content"). By uploading, you grant us a limited license to process and store Your Content solely for the purpose of providing the Service to you.
Accuracy
You are responsible for the accuracy of all information you provide. BidVictor uses Your Content to generate proposals on your behalf. Inaccurate inputs produce inaccurate outputs; we have no way to verify information you supply.
Storage and retention
We store Your Content and generated proposals as part of your account. Proposals are retained as long as your account remains active. After account termination, we may delete Your Content on 30 days' notice.
No sale of your data
We do not sell your company information, uploaded documents, or generated proposals to third parties.
8. AI-Generated Proposal Content
Nature of outputs
BidVictor uses AI models to generate proposal text. AI-generated content reflects general knowledge and patterns from training data, not specific expertise in your industry, your company's history, or the particular agency evaluating your bid.
Your review obligation
You must review all AI-generated content before including it in a submitted proposal. You are responsible for verifying that:
- All facts, figures, and claims are accurate and supported
- The proposal meets the solicitation's requirements and formatting standards
- All certifications and past performance references are truthful and current
- The proposal complies with all applicable procurement laws and regulations
No guarantee of compliance
BidVictor does not guarantee that any generated proposal will comply with a specific solicitation's requirements, page limits, formatting instructions, or submission procedures.
Your responsibility as offeror
Submission of a proposal is your act, not ours. You bear full responsibility for the content of any proposal you submit to a government agency or other client.
9. Intellectual Property Rights
Our platform
BidVictor and its underlying technology, including the software, AI models, interfaces, and documentation, are owned by BidVictor and protected by applicable intellectual property law. These Terms do not transfer any ownership or license rights to you beyond what is expressly stated.
Your proposals
Proposal documents generated through BidVictor and downloaded to your devices are yours. We do not claim ownership of final proposal PDFs you produce and download through the Service.
Feedback
If you provide feedback or suggestions about the Service, you grant us a non-exclusive, perpetual license to use that feedback in any way without compensation to you.
10. Privacy and Data Security
Your use of BidVictor is governed by our Privacy Policy, which is incorporated into these Terms by reference. We store data in the United States using secure cloud infrastructure. We maintain security practices appropriate for the nature of the data we process, but no system is completely secure and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and for any data breach that results from your failure to protect those credentials.

11. Disclaimers; No Professional Advice
As-is basis
BidVictor is provided on an "as is" and "as available" basis. We make no warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements, be error-free, or operate without interruption.
No professional advice
Nothing in the Service constitutes legal advice, financial advice, contracting advice, or advice of any kind from a licensed professional. BidVictor-generated content is a starting draft, not a reviewed or certified document. Do not rely on it as a substitute for advice from a qualified attorney, accountant, or contracting officer.
No guarantee of award
Using BidVictor does not guarantee that you will win a contract, meet agency evaluation criteria, be deemed technically acceptable, or receive any award.
Government compliance
You are solely responsible for ensuring your proposals comply with applicable procurement regulations, including the Federal Acquisition Regulation (FAR), agency- specific supplements, and any state or local procurement rules that apply to the solicitation.
12. Limitation of Liability
To the fullest extent permitted by law:
- BidVictor's total liability for any claim arising out of these Terms or your use of the Service is limited to the total amount you paid us in the three months before the claim arose.
- BidVictor is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost contracts, or lost business opportunities, even if we were advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the minimum extent permitted by law.
13. General Provisions
Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising from these Terms will be resolved exclusively in the state or federal courts located in Atlanta, Georgia, and you consent to personal jurisdiction in those courts.
Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the portal before the changes take effect. Continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms. The current version is always available at bidvictor.com/tos.
Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and BidVictor regarding the Service and supersede all prior agreements or understandings on the same subject.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
No waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it at a later time.
